Overtime is paid at twice the ordinary rate, but the "ordinary hourly rate" isn't worked out the same way everywhere. Some employers divide the monthly wage by 26 working days, others by 30. That small difference changes your overtime pay.
The same overtime, two ways
| Monthly wage | Overtime an hour (26 days) | An hour (30 days) | 24 hours (26 days) | 24 hours (30 days) | Difference |
|---|---|---|---|---|---|
| Rs 45,000 | Rs 433 | Rs 375 | Rs 10,385 | Rs 9,000 | Rs 1,385 |
| Rs 60,000 | Rs 577 | Rs 500 | Rs 13,846 | Rs 12,000 | Rs 1,846 |
| Rs 100,000 | Rs 962 | Rs 833 | Rs 23,077 | Rs 20,000 | Rs 3,077 |
For someone working six days a week, 26 days is closer to the truth, because there are no working hours on the day off.
Hours limits
- Under the Factories Act 1934 the normal limit is 9 hours a day and 48 hours a week; time beyond that is overtime.
- Overtime is paid at twice the ordinary rate of wages (section 47).
- Basic pay and dearness allowance count, not allowances like house rent.
