When an unmarried son dies with no wife or children, his estate goes to his parents and brothers and sisters. But under the Hanafi school, which Pakistani courts apply, the father blocks the brothers and sisters, and the number of siblings changes the mother's share.
A Rs 10,000,000 net estate: three situations
Father, mother and two brothers
| Heir | Share | Amount |
|---|---|---|
| Mother | 1/6 | Rs 1,666,667 |
| Full brothers (2) | blocked | Rs 0 |
| Father | 5/6 | Rs 8,333,333 |
Mother, one brother and one sister (father died earlier)
| Heir | Share | Amount |
|---|---|---|
| Mother | 1/6 | Rs 1,666,667 |
| Full brother | 5/9 | Rs 5,555,556 |
| Full sister | 5/18 | Rs 2,777,778 |
Mother and one brother (father died earlier)
| Heir | Share | Amount |
|---|---|---|
| Mother | 1/3 | Rs 3,333,333 |
| Full brother | 2/3 | Rs 6,666,667 |
What stands out
In the first case the brothers get nothing, yet because there are two or more siblings the mother's share falls from 1/3 to 1/6. In the third case there's only one brother, so the mother gets 1/3.
